| AMENDMENTS TO THE CONSTITUTIONThe framers of the Constitution included what was thought to be relatively easy amendment procedures in Article V: "On application of two-thirds of the states, Congress is to convene a convention to write changes, or Congress itself by a vote of two-thirds of each house may propose changes." Then, when ratified by three-fourths of the states, the amendment becomes part of the Constitution. Efforts in the first Congress to integrate amendments into the body of the document were beaten back in favor of leaving the Constitution exactly in the form in which it was ratified, adding amendments at the end. Though seemingly an uncomplicated process, the Constitution has seen relatively few changes—only twenty-seven amendments in more than two hundred years. The first ten, of course, constituting what has come to be called the Bill of Rights, were added in 1791, two years after the inauguration of the government. Two others attempting to protect states from suits and altering the electoral college followed within the next decade. There were none between 1804 and 1865, when the three "Reconstruction amendments" relating to slavery and the rights of the freedmen became law in 1865, 1868, and 1875. Other than the Bill of Rights, only one amendment has made a fundamental alteration in the federal constitutional system. The Fourteenth Amendment greatly restricts state activity and has proven to be the major bulwark against state limitations of individual liberty. The other amendments alter the American system of government by legitimating an income tax, providing for direct election of senators, prohibiting states from excluding women and minors over eighteen from the suffrage, and limiting the president to two terms. One amendment stands out as a classic case of constitutionalizing what should be merely a legislative matter. The eighteenth amendment prohibited "the manufacture, sale, or transportation of intoxicating liquors. "The proof of the folly of this action is the Twenty-first Amendment, which repealed the Eighteenth in 1933 after only thirteen years. |
